Terms of Use

Using the service

These operational draft terms describe the conditions proposed for using WorkCheck. Read them with the Privacy Policy and Report Guidelines. Use the service only if you can lawfully agree to these terms and are an adult. If you do not agree, do not submit content or use the service.

WorkCheck provides ABN searches, official registry information and worker-submitted employment accounts across Australian industries. It is independent and is not affiliated with ABR, ATO, Fair Work Ombudsman or another government agency.

Email verification and acceptable use

Browsing ABN information and public reports does not require authentication. Report submission requires verified email and security checks. Keep codes and session credentials private. Do not impersonate another person, bypass controls, access private information without authority or interfere with the service.

Submit only genuine employment experience. Fabricated, knowingly false, defamatory, retaliatory, abusive, threatening or discriminatory content is prohibited, as are doxxing, spam, duplicate abuse and coordinated report manipulation. Users remain responsible for their submissions. A genuine critical account is not prohibited merely because it is unfavourable to a business.

Your content and our limited licence

You retain ownership of your content. You grant WorkCheck a non-exclusive, royalty-free licence to store, reproduce, format and display the public content you submit, and to review, redact or remove it as reasonably needed to operate and moderate the service. Service providers may process it for those purposes. This does not transfer ownership or authorise unrelated commercial use.

Private evidence is licensed only for storage, processing, moderation, security and lawful review purposes, not public display. Provide only material you may lawfully share and redact irrelevant personal data. Retention follows the Privacy Policy: public reports remain while active or reasonably necessary; private evidence has a conditional 90-day deletion target after permanent removal/deletion, and moderation/audit/security records normally have a target of up to 12 months where reasonably necessary. Disputes, investigations, legal obligations or claims may justify longer retention as described there. These targets are not statutory periods or promises of unconditional deletion; automated enforcement and guaranteed backup-deletion timing are not currently available.

Publication, evidence and moderation

Reports are user-submitted allegations or accounts, not government findings. “Approved” and “published” describe moderation/publication states, not independent verification. Suitable text evidence containing an exact valid target ABN can trigger automatic publication of an eligible new report.

“Employment evidence provided” or “employment evidence ABN matched” does not prove a reported allegation, authenticate every document or establish liability. Official ABR information is presented separately from worker reports.

WorkCheck may review, reject, hide, redact, remove or restore content and restrict service access where reasonably needed to apply these policies, prevent abuse, protect privacy or meet legal obligations. Reporters, businesses and authorised representatives may request review under the Dispute / Review Policy. Publication is not guaranteed.

Information limits and professional advice

ABR data may be cached, incomplete or stale. Worker reports may contain errors or contested accounts. WorkCheck does not guarantee completeness, accuracy, uninterrupted availability or suitability for a particular purpose, subject always to rights that cannot lawfully be excluded.

WorkCheck does not provide legal, migration, tax, financial, employment or other professional advice. Check relevant original sources and seek qualified advice where needed. Do not use WorkCheck as the sole basis for a major employment or legal decision.

Intellectual property and third parties

WorkCheck’s branding, software and original presentation are protected by applicable intellectual property rights. Your submissions remain yours; official records and third-party material remain subject to their owners’ rights. Do not imply endorsement or affiliation.

Third-party services and linked sites operate under their own terms and privacy arrangements. Their availability and content are outside WorkCheck’s complete control. We may change or suspend features for maintenance, security or operational reasons.

Liability and Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, remedy or other right under the Australian Consumer Law or other law that cannot lawfully be excluded, restricted or modified.

To the extent permitted by law, WorkCheck is not responsible for loss caused solely by inaccurate third-party material or a user’s misuse of the service. This limitation does not exclude liability for WorkCheck’s own conduct where the law makes WorkCheck responsible. No blanket waiver of statutory remedies or broad user indemnity is imposed by this draft. Seek advice before relying on this clause.

Changes, governing law and contact

We may revise these terms and update their date. Material changes should be notified appropriately and do not retrospectively remove accrued rights. These terms are intended to operate under applicable Australian law, with access to courts of competent jurisdiction and any mandatory consumer protections preserved. No exclusive state jurisdiction is specified in this draft.

Contact and review arrangements appear below and in the Dispute / Review Policy. The service is referred to as WorkCheck; no company name or residential address is asserted. Australian counsel should confirm whether further legal operator information must be supplied or displayed before public launch.
